These Terms of Service ("Terms") govern your use of this website, operated by Niagara 40 Under Forty Business Achievement Awards("we", "us", "our") to accept and judge award nominations and applications. By using this site, you agree to these Terms.
The service
This site lets you nominate someone for, or apply yourself to, the awards program, view your own submissions, and (for designated judges and administrators) review and manage submissions.
Eligibility
Applicants and nominees must meet the eligibility criteria stated on the application and nomination forms at the time of submission (for example, age and location requirements). We may update these criteria from year to year.
Your submissions
You're responsible for the accuracy of information you submit, and for having the nominee's or any reference's permission to share their contact information with us. You retain ownership of what you submit, and you grant us permission to use it to administer and promote the awards program.
Uploaded files
If you attach a photo or supporting documents to your application, you're responsible for having the right to share them with us and for their content being accurate and appropriate. By uploading a file, you consent to it being visible to administrators and approved judges as part of reviewing applications — uploaded files are not made public. Removing an attachment takes it out of view, but a copy may persist in our backend for record-keeping; contact us at the email below if you need a file permanently deleted.
Judging
Selection and scoring decisions are made at our sole discretion. Submitting a nomination or application does not guarantee selection, an award, or any particular outcome.
Acceptable use
You agree not to submit false information, impersonate someone else, or otherwise misuse this site.
Disclaimer and limitation of liability
This site is provided "as is," without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect or consequential damages arising from your use of this site.
Changes
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continuing to use the site after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Ontario, Canada.
